WHOLESALE TERMS & CONDITIONS

Effective from: 18 August 2026

 

These Wholesale Terms & Conditions apply to the supply of products by Mumma G Patisserie to cafés, restaurants, hotels, private members’ clubs, caterers and other business customers.

 

By placing an order with Mumma G Patisserie, the customer confirms that they have read, understood and accepted these Wholesale Terms & Conditions.

 

1. About Mumma G Patisserie

Mumma G Patisserie is a specialist patisserie supplier based in South East London, providing handcrafted desserts and patisserie products to hospitality businesses. 

Our products may include cakes, individual desserts, cheesecakes, brownies, traybakes, loaf cakes, cookies, dessert pots and bespoke products developed for individual customers.

 

2. Wholesale Customers

Our wholesale service is intended for businesses and professional hospitality customers. 

Customers are responsible for providing accurate business, billing and delivery information when opening an account or placing an order. 

Mumma G Patisserie reserves the right to request additional information before accepting a new wholesale account or order.

 

3. Product Information

Product descriptions, photographs and specifications are provided to give customers an indication of the products supplied. 

Because our products are handcrafted, there may be minor variations in appearance, decoration, size or finish between individual products. 

Where a bespoke product or specification has been agreed with the customer, Mumma G Patisserie will make reasonable efforts to supply the product according to the agreed specification.

 

4. Prices

All prices will be confirmed by quotation, price list, order confirmation or invoice. 

Unless otherwise stated, prices are exclusive of VAT. 

Prices may change from time to time due to changes in ingredient, packaging, labour, energy, transport or other business costs. 

Mumma G Patisserie will confirm any applicable price changes before they apply to future orders.

 

5. Minimum Orders

Minimum wholesale order quantities or values may apply depending on the product and delivery location. 

Any applicable minimum order requirement will be communicated to the customer before the order is accepted. 

Mumma G Patisserie reserves the right to refuse or amend an order that does not meet an applicable minimum order requirement.

 

6. Placing an Order

Orders may be placed by email, telephone, website enquiry or another agreed communication method. 

An order is not considered accepted until Mumma G Patisserie has confirmed the order. 

Once an order has been confirmed, the customer may be liable for reasonable costs incurred by Mumma G Patisserie if the customer subsequently cancels or substantially changes the order.

 

7. Bespoke Products

Where a customer requests a bespoke product, Mumma G Patisserie may provide a quotation or specification before production. 

Bespoke products may require additional preparation, development, ingredients, packaging or production time. 

Once a bespoke order has been approved and production or preparation has commenced, cancellation may not be possible and the customer may be responsible for reasonable costs already incurred.

 

8. Order Changes and Cancellations

Customers are required to provide at least 2 working days’ notice when requesting any changes to or cancellation of an order. 

Customers are encouraged to provide as much notice as possible to allow Mumma G Patisserie to manage production and minimise food waste. 

Changes or cancellations requested with less than 2 working days’ notice may not be accepted and may be subject to a reasonable cancellation charge to cover ingredients, labour, packaging and other costs already incurred. 

For bespoke, customised or specially prepared products, cancellation may not be possible once production or preparation has commenced, regardless of the notice period.

 

9. Order Cut-Off Times and Delivery

Wholesale orders must be placed by 2:00 pm on a working day to be processed for production. 

Orders received after 2:00 pm will be treated as being received on the next working day. 

Mumma G Patisserie aims to deliver wholesale orders within 3 working days from the date the order is confirmed, subject to product availability, production capacity and the agreed delivery arrangements. 

Delivery dates and times will be confirmed with the customer where possible. 

Delivery times may occasionally be affected by circumstances outside our reasonable control, including traffic, severe weather, vehicle problems, courier delays, ingredient availability or other unforeseen circumstances. 

The customer is responsible for ensuring that someone is available to receive the delivery at the agreed delivery location.

If a delivery cannot be completed because nobody is available to receive it, additional

delivery charges may apply.

For bespoke, large-volume or specially prepared orders, a longer lead time may be required. Mumma G Patisserie will advise the customer of the required lead time before confirming the order.

 

10. Delivery

Delivery dates and times will be agreed with the customer where possible.

Delivery times may occasionally be affected by circumstances outside our reasonable control, including traffic, severe weather, vehicle problems, courier delays or other unforeseen circumstances.

The customer is responsible for ensuring that someone is available to receive the delivery at the agreed delivery location.

If a delivery cannot be completed because nobody is available to receive it, additional delivery charges may apply.

 

11. Delivery Charges

Delivery charges may apply depending on the order value, delivery location and agreed delivery arrangements.

Any applicable delivery charge will be communicated to the customer before the order is confirmed.

 

12. Receiving Products

Customers should check deliveries as soon as reasonably possible.

Customers should check:

  • Quantity
  • Product type
  • Packaging
  • Visible damage
  • Condition of the products
  • Delivery temperature where applicable

Any visible damage, incorrect products or missing items should be reported to Mumma G Patisserie as soon as possible and preferably on the day of delivery.

Photographs may be requested to assist with investigating a complaint.

Customers should retain relevant packaging and affected products where reasonably possible if a complaint is made.

 

13. Product Storage and Handling

Customers are responsible for storing and handling products correctly once delivery has been completed.

Storage instructions and recommended shelf life will be provided where applicable. 

Customers must follow all storage, temperature and handling instructions supplied by Mumma G Patisserie.

Mumma G Patisserie cannot accept responsibility for deterioration, damage or food safety issues caused by incorrect storage, handling, display or use after delivery.

 

14. Shelf Life

Recommended shelf-life information will be provided for applicable products.

Customers must ensure that products are used, displayed and stored within the recommended period.

Where a customer requests an alternative shelf-life arrangement or storage method, this must be agreed with Mumma G Patisserie in advance.

 

15. ALLERGENS AND INGREDIENTS

Mumma G Patisserie takes food allergies and intolerances seriously and will provide relevant ingredient and allergen information for products supplied.

Customers must ensure that they have received and understood the relevant allergen information before serving or selling products to their own customers.

The 14 regulated allergens are:

  • Celery
  • Cereals containing gluten, including wheat, rye, barley and oats
  • Crustaceans
  • Eggs
  • Fish
  • Lupin
  • Milk
  • Molluscs
  • Mustard
  • Peanuts
  • Sesame
  • Soya
  • Sulphur dioxide and sulphites, where applicable
  • Tree nuts

Allergen information will be based on the ingredients, recipes and production processes used at the time of manufacture.

Allergen information may change if recipes, ingredients, suppliers or production processes change.

Customers must always use the most recent product specification and allergen information provided by Mumma G Patisserie.

 

16. Allergen Cross-Contact

Mumma G Patisserie operates a professional food production environment where multiple ingredients and allergens may be handled.

Reasonable precautions are taken to minimize cross-contact between allergens; however, unless specifically agreed in writing, Mumma G Patisserie does not guarantee an allergen-free production environment.

Where relevant, potential cross-contact information will be communicated to the customer.

 

17. Customer Responsibility for Allergens

Once products have been delivered, the customer is responsible for:

  • Correct storage and handling
  • Preventing cross-contamination or cross-contact during their own handling
  • Ensuring staff have access to current allergen information
  • Ensuring appropriate allergen information is provided to their own customers
  • Ensuring that products are not altered in a way that makes the supplied allergen information inaccurate

Customers must not assume that a product is suitable for a particular allergy or intolerance without checking the current allergen information.

 

18. Product Modification and Repackaging

If a customer:

  • Adds ingredients
  • Adds toppings or decorations
  • Combines the product with another food
  • Changes the product
  • Repackages the product
  • Portions or alters the product
  • Uses the product as an ingredient in another recipe

the customer is responsible for assessing the resulting product and providing accurate allergen and food information to their own customers.

Customers must not remove, alter or obscure allergen information supplied by Mumma G Patisserie where doing so could result in inaccurate or misleading information being provided.

 

19. Gluten-Free and Vegan Products

Where a product is described as gluten-free, vegan or suitable for a particular dietary requirement, this will be based on the agreed product specification and ingredients used.

Customers must not make additional claims about a product without confirming the relevant information with Mumma G Patisserie.

Where cross-contact risks exist, these will be communicated through the relevant product or allergen information.

Customers must not describe a product as completely free from an allergen unless this has been specifically confirmed by Mumma G Patisserie in writing.

 

20. Allergen-Related Enquiries and Complaints

Customers must contact Mumma G Patisserie before placing an order if they have a specificallergen, dietary or ingredient requirement that is not covered by the standard product information.

If a customer believes there is an allergen-related issue with a product, they must contact Mumma G Patisserie immediately.

The customer may be asked to provide:

  • Product name
  • Order or invoice number
  • Delivery date
  • Batch or product information, where available
  • Details of the concern
  • Photographs where relevant
  • Details of how the product was stored and handled

Where possible, the affected product and packaging should be retained until Mumma G Patisserie has had an opportunity to investigate.

 

21. Complaints

If a customer believes that a product is damaged, defective, incorrect or otherwise not in accordance with the agreed order, they should contact Mumma G Patisserie as soon as reasonably possible.

The customer may be asked to provide:

  • Order or invoice number
  • Description of the issue
  • Photographs
  • Quantity affected
  • Relevant batch or product information
  • Details of how the product was stored and handled

Mumma G Patisserie will investigate genuine complaints and, where appropriate, may offer a replacement, credit or refund.

 

22. Payment Terms

Unless otherwise agreed in writing, payment is due according to the payment terms stated on the relevant invoice.

New customers: Payment is due within 7 days of the invoice date.

Regular customers: Payment terms of 7–14 days may be offered at the discretion of Mumma G Patisserie and will be confirmed in writing.

Mumma G Patisserie reserves the right to review, reduce, suspend or withdraw credit facilities where invoices are overdue.

Where an account has overdue invoices, Mumma G Patisserie may require all future orders to be paid in full before production or delivery.

 

23. Late Payment

If an invoice is not paid by the agreed due date, Mumma G Patisserie may take appropriate steps to recover the outstanding amount.

Where applicable, Mumma G Patisserie may claim statutory interest and fixed compensation for qualifying late commercial payments in accordance with applicable UK legislation.

Statutory interest for qualifying business-to-business debts is generally 8% above the Bank of England base rate, unless a different contractual interest rate applies.

 

24. Non-Payment

 

If an account becomes overdue, Mumma G Patisserie may:

  • Suspend further deliveries
  • Require payment in advance
  • Suspend or withdraw credit facilities
  • Cancel future orders
  • Recover reasonable costs associated with recovering outstanding debts

Any suspension of supply will not remove the customer’s obligation to pay outstanding invoices.

 

25. Product Ownership and Risk

Unless otherwise agreed in writing, ownership of products passes to the customer once full payment for those products has been received.

Risk in the products passes to the customer upon delivery.

The customer remains responsible for the products after delivery, including their storage, handling and use

26. Intellectual Property

All recipes, product concepts, photographs, designs, branding, packaging designs, written materials and other intellectual property belonging to Mumma G Patisserie remain the property of Mumma G Patisserie unless otherwise agreed in writing.

Customers must not copy, reproduce, sell or commercially reproduce Mumma G Patisserie’s recipes, photographs, branding, designs or product concepts without written permission.

Where a bespoke product has been developed specifically for a customer, any intellectual property arrangements may be agreed separately in writing.

 

27. Use of Product Photography and Branding

Mumma G Patisserie may provide product photographs for customers to use for marketing purposes.

Customers must not edit, reproduce or use Mumma G Patisserie branding or photography in a misleading manner.

Any use of Mumma G Patisserie’s logo or brand identity requires prior permission.


28. Product Availability

Mumma G Patisserie will make reasonable efforts to maintain availability of advertised products.

However, availability may be affected by ingredient supply, production capacity, equipment failure, staff availability or other circumstances beyond our reasonable control.

Where a product becomes unavailable, Mumma G Patisserie may offer a suitable alternative or refund or credit the affected product where appropriate.

 

29. Ingredients and Suppliers

Mumma G Patisserie reserves the right to change ingredients or suppliers where reasonably necessary, provided that the resulting product continues to meet the agreed specification as far as reasonably practicable.

Where a change materially affects allergens or agreed dietary requirements, appropriate updated information will be provided.

 

30. Liability

Mumma G Patisserie will take reasonable care in preparing, packaging and supplying products.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Subject to applicable law, Mumma G Patisserie will not be responsible for loss or

deterioration arising from:

  • Incorrect storage or handling after delivery
  • Unauthorised alteration or modification of products
  • Failure to follow storage or product instructions
  • Failure by the customer to follow the allergen information provided
  • Events outside Mumma G Patisserie’s reasonable control

Nothing in these Terms & Conditions limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded or limited.

 

31. Force Majeure

Mumma G Patisserie will not be responsible for delays or failure to perform its obligations where this is caused by circumstances beyond its reasonable control.

This may include severe weather, flooding, fire, equipment failure, power failure, transport disruption, supplier failure, industrial action, illness, government action or other unforeseen circumstances.

Mumma G Patisserie will make reasonable efforts to minimise the impact and communicate with affected customers.

 

32. Confidentiality

Where a customer provides commercially sensitive information to Mumma G Patisserie, both parties will take reasonable steps to keep such information confidential. This does not prevent either party from using information where required by law or where necessary to perform the agreement.

 

33. Data Protection

Mumma G Patisserie will process personal information in accordance with its Privacy Policy and applicable UK data protection legislation.

Our Privacy Policy is available on the Mumma G Patisserie website.


34. Changes to These Terms

Mumma G Patisserie may update these Terms & Conditions from time to time.

The Terms & Conditions applying to an order will be those accepted by the customer at the time the order is placed, unless otherwise agreed in writing.

Any significant changes affecting existing ongoing supply arrangements will be

communicated to the relevant customer.


35. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, unless applicable law requires otherwise.

 

36. Acceptance

By placing an order with Mumma G Patisserie, the customer confirms that they have read, understood and accepted these Wholesale Terms & Conditions.

Where a separate written supply agreement has been signed between Mumma G Patisserie and the customer, that agreement will take precedence over these Terms & Conditions where there is a conflict.

26. Intellectual Property

All recipes, product concepts, photographs, designs, branding, packaging designs, written materials and other intellectual property belonging to Mumma G Patisserie remain the property of Mumma G Patisserie unless otherwise agreed in writing.

Customers must not copy, reproduce, sell or commercially reproduce Mumma G Patisserie’s recipes, photographs, branding, designs or product concepts without written permission.

Where a bespoke product has been developed specifically for a customer, any intellectual property arrangements may be agreed separately in writing.

 

27. Use of Product Photography and Branding

Mumma G Patisserie may provide product photographs for customers to use for marketing purposes.

Customers must not edit, reproduce or use Mumma G Patisserie branding or photography in a misleading manner.

Any use of Mumma G Patisserie’s logo or brand identity requires prior permission.


28. Product Availability

Mumma G Patisserie will make reasonable efforts to maintain availability of advertised products.

However, availability may be affected by ingredient supply, production capacity, equipment failure, staff availability or other circumstances beyond our reasonable control.

Where a product becomes unavailable, Mumma G Patisserie may offer a suitable alternative or refund or credit the affected product where appropriate.

 

29. Ingredients and Suppliers

Mumma G Patisserie reserves the right to change ingredients or suppliers where reasonably necessary, provided that the resulting product continues to meet the agreed specification as far as reasonably practicable.

Where a change materially affects allergens or agreed dietary requirements, appropriate updated information will be provided.

 

30. Liability

Mumma G Patisserie will take reasonable care in preparing, packaging and supplying products.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Subject to applicable law, Mumma G Patisserie will not be responsible for loss or deterioration arising from:

  • Incorrect storage or handling after delivery
  • Unauthorised alteration or modification of products
  • Failure to follow storage or product instructions
  • Failure by the customer to follow the allergen information provided
  • Events outside Mumma G Patisserie’s reasonable control

Nothing in these Terms & Conditions limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded or limited.

 

31. Force Majeure

Mumma G Patisserie will not be responsible for delays or failure to perform its obligations where this is caused by circumstances beyond its reasonable control.

This may include severe weather, flooding, fire, equipment failure, power failure, transport disruption, supplier failure, industrial action, illness, government action or other unforeseen circumstances.

Mumma G Patisserie will make reasonable efforts to minimise the impact and communicate with affected customers.

 

32. Confidentiality

Where a customer provides commercially sensitive information to Mumma G Patisserie, both parties will take reasonable steps to keep such information confidential. This does not prevent either party from using information where required by law or where necessary to perform the agreement.

 

33. Data Protection

Mumma G Patisserie will process personal information in accordance with its Privacy Policy and applicable UK data protection legislation.

34. Changes to These Terms

Mumma G Patisserie may update these Terms & Conditions from time to time.

The Terms & Conditions applying to an order will be those accepted by the customer at the time the order is placed, unless otherwise agreed in writing.

Any significant changes affecting existing ongoing supply arrangements will be

communicated to the relevant customer.


35. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, unless applicable law requires otherwise.

 

36. Acceptance

By placing an order with Mumma G Patisserie, the customer confirms that they have read, understood and accepted these Wholesale Terms & Conditions.

Where a separate written supply agreement has been signed between Mumma G Patisserie and the customer, that agreement will take precedence over these Terms & Conditions where there is a conflict.
